Realtor and seller obligations under a listing agreement.

When a seller gives a Broker the exclusive right to sell their home or real estate, each party of the listing contract have obligations to each other.

When using a Florida Association of Realtors exclusive right of sale listing agreement the obligations the seller and Broker have agreed to include:

Broker
  • Advertise the home
  • Gather mortgage information on the home
  • Continuous efforts to sell the home
  • Enter home's information into the multiple listing service
  • Provide buyers with comparable market information about the home
  • Place a lockbox on the property

Seller

  • Assist Broker including referring interested potential buyers to Realtor
  • Allow the property to be viewed, providing keys when appropriate
  • Inform the Realtor prior to leasing home
  • Hold the Broker harmless in certain situations
  • Comply with FIRPTA
  • Disclose all know material facts about the property

These are a few of the obligations owed between a seller and their listing Realtor. If you are thinking about listing your home or real estate give us a call and we will be happy to discuss the listing contract and seller/Broker obligations in detail.
