Judge suggests mediation before foreclosure

The Florida Bar News is reporting that 12th Circuit Chief Judge Lee Haworth has suggested that the State require mediation prior to foreclosure between the lender and the home owner. Judge Haworth is quoted in the report as stating:

“The idea is there are so many opportunities for people to resolve their
case short of being foreclosed and having to leave the home, but the window of
opportunity is short,” Haworth said. “It keeps cases from going into our court
system and allows people at that sensitive time before a foreclosure, but when
people know it’s imminent, to get together and talk about the options.”

The mediation would only be for homestead properties with the hope of opening up lines of communications between the lender and borrower that might prevent foreclosure.

Of course those who are creating these illegal schemes and bilking innocent people out of thousands of dollars understand the tremendous stress the person is under and how they are eager for help, any help regardless of what it is.

As of January 16th, 2009 builders who have a partial of full ownership interest with a lender are not allowed to offer an exclusive incentive that requires buyers to use their lender.
