Builders must offer the same incentive to everyone

In the past builders could offer an incentive to a buyer if the buyer agreed to use the builder's mortgage company. As of January 16th, 2009 builders who have a partial of full ownership interest with a lender are not allowed to offer an exclusive incentive that requires buyers to use their lender.

Builders must now offer the same incentives (closing costs - upgrades, etc.) to all buyers regardless of who the buyer uses as their mortgage lender. This new rule is a result of HUD's final RESPA ruling.
