Builders confident buyers will take advantage of tax credit

In a recent news release The National Association of home Builders expressed confidence that the recently passed $7500 tax credit will bring first time home buyers into the market which they believe will strengthen the housing industry and reduce the over supply of inventory.

Do you need a volunteer? Ask a home owner.

According to a U.S. government site, home owners are more likely to volunteer in their community than those who do not own their home.

Quoting the study; "There is a strong positive relationship between homeownership rates and metropolitan volunteer rates, indicating that where homeownership rates are high, volunteering is also high. "

The report further stated that in areas where there is a large percentage of apartment buildings, the volunteer rate is lower.

I am not going to give my home away!

Somewhere between "I am not going to give my home away" and " this home is never going to sell", is the right price where the home does sell, even in this market.

What sellers and their real estate agents should know by now is that the sold price cannot be influenced by:
  • What the seller needs to get
  • What the seller paid for it
  • Offerings of incentives, higher commissions or concessions
  • Time

The sold price is only determined by:

  • A buyers interest
  • Continuous and aggressive pricing strategy

Buyer's interest is obtained by using a professional marketing and prospecting plan that has proven success in finding qualified buyers.

The continuous and aggressive pricing strategy centers on determining the real value of the home at the onset and not being distracted by forces that have no bearing on what a home should be listed for. The continuous effort is accomplished by watching the values of homes in a given area and instead of chasing down the market with regards to pricing, the agent and the seller will need to stay ahead of the market and counter any changes with reductions in price that are substantial and effective.

If a seller is unable to meet the criteria needed to sell then they should consider not listing their home for sale.

Realtor and seller obligations under a listing agreement.

When a seller gives a Broker the exclusive right to sell their home or real estate, each party of the listing contract have obligations to each other.

When using a Florida Association of Realtors exclusive right of sale listing agreement the obligations the seller and Broker have agreed to include:

Broker
  • Advertise the home
  • Gather mortgage information on the home
  • Continuous efforts to sell the home
  • Enter home's information into the multiple listing service
  • Provide buyers with comparable market information about the home
  • Place a lockbox on the property

Seller

  • Assist Broker including referring interested potential buyers to Realtor
  • Allow the property to be viewed, providing keys when appropriate
  • Inform the Realtor prior to leasing home
  • Hold the Broker harmless in certain situations
  • Comply with FIRPTA
  • Disclose all know material facts about the property

Let's suppose you have exactly $1 million dollars to spend on a Central Florida home. Which county should you visit first in hopes of finding the right million dollar home?

  • You may want to visit Seminole County first. The Mid-Florida MLS indicates that there are 4 homes for sale in Seminole County, home of Longwood and Lake Mary, all with a $1 million dollar price tag.


  • Orange County which is home to Orlando has 3 homes priced at $1 million along with Lake County with 3. Osceola County had 1 home in Saint Cloud.

Should you buy a home in "as is" condition?

Even with it being a buyer's market I see an increasing number of buyers agreeing to purchase a home in "as is" condition. The term "as is" would basically mean that the seller is making no warranties other than clear title and the seller does not intend to make any repairs.

The increase in as is offers could be a result of the increase of bank owned and short sale contingency homes that are now making up a large part of the Central Florida home inventory. Bank addendum often require buyers to sign as is clauses and sellers who are contingent upon a short sale, will need to sell as is simply because of having no money for repairs.

Buyers can still protect themselves when buying a home as is by making sure they make their contract "as is with right to inspect".

An as is with right to inspect addendum will allow the buyer a legal way to cancel the contract should an inspection reveal conditions or repairs the buyer is unwilling to accept. the buyer will need to notify the seller in writing of the conditions or repairs that the inspection report revealed that are not acceptable to the buyer and are the reason for the cancellation.

Buyers can choose to accept the property in the condition reported and move forward with the sale or in some cases the seller may decide that it is in their best interest to make the repairs for the buyer in order to successfully close the transaction.

When buying a home as is you should talk to your Realtor about making sure your interests are protected and if need be, you should seek the advice of an attorney prior to executing a contract.

Bradenton, Florida bank closed. First Priority Bank

In an FDIC press release it was announced that the Florida bank, First Priority was closed today today by the Commissioner of the Florida Office of Financial Regulation.

The 6 branches will open on Monday as branches of SunTrust Bank.
