The contract to purchase a home includes a clause that deals with property disclosure. The buyer should be able to purchase the home confident that the seller has disclosed "any facts that materially affect the value of the home".
When we list property, we ask that the seller to complete a written property disclosure that we will then provide to interested buyers of the home or property. The property disclosure should not be used in place of the buyer obtaining all the inspections they feel necessary and asking for a home warranty.
